These Terms apply to all entities within the Something Big Hospitality group, including but not limited to: parent companies, subsidiaries, affiliates, investment entities, managed brands, partner venues, and any future businesses acquired or created.

If you do not agree to these Terms, please discontinue use of the Site immediately.

1. Eligibility

You must be at least 18 years old to use this Site. By using the Site, you represent and warrant that you meet this requirement.

2. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Access or attempt to access any non-public areas of the Site, servers, or systems;

  • Use automated tools (including bots, scrapers, crawlers, or spiders) without our prior written consent;

4. No Guarantee of Accuracy or Availability

We do not guarantee that:

  • The Site, any Content, or any Services will be available at all times;

  • The information presented on the Site is accurate, complete, or current;

  • Any venues, offerings, experiences, or events described on the Site will be available at the time you choose to attend or book.

All offerings, experiences, pricing, availability, and descriptions are subject to change without notice.

5. Group-Level and Venue Liability

Something Big Hospitality is a group that may own, invest in, manage, or partner with multiple brands and venues.

Accordingly, you acknowledge and agree that:

  • The Site does not create any direct liability for the Company related to the operations, conditions, safety, or activities at any specific venue or property;

  • The Site does not constitute any representation, promise, or guarantee regarding the condition, safety, policies, or performance of any individual venue, operator, or partner;

  • Information about venues, events, or experiences may be provided by third parties and may not always be independently verified by us.

Any questions or concerns about a specific property or venue should be directed to that location’s management.

6. Alcohol and Participation Disclaimers

Some venues within our group, or venues we partner with or invest in, may serve alcohol and/or host nightlife, entertainment, or experiential events.

By using the Site, attending any affiliated venue, or participating in any related experience, you acknowledge and agree that:

  • Participation in hospitality, nightlife, and event activities is voluntary and may involve inherent risks;

  • Alcohol consumption should be done responsibly and in accordance with all applicable laws;

  • You assume full responsibility for your own decisions, actions, and general behavior;

  • The Company is not liable for injuries, damages, incidents, or losses arising out of or related to alcohol consumption, disorderly conduct, or participation in any activity or event.

The Company does not assume responsibility for the conduct of any guest, staff member, vendor, performer, or third-party service provider.

7. User Submissions

If you submit or post any content to the Site, including but not limited to reviews, comments, photos, suggestions, or other materials (“User Content”), you:

  • Grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in any media now known or later developed, for any business purpose;

  • Represent and warrant that you own or otherwise control all rights to the User Content and that the User Content does not violate any law or third-party rights.

  • Damages arising out of or related to the acts, errors, or omissions of guests, staff, vendors, or third-party partners.

This limitation applies even if we have been advised of the possibility of such damages.

14. Assumption of Risk

By using the Site, attending any affiliated venue, or participating in any related event or experience, you knowingly and voluntarily assume all risks associated with:

  • Alcohol consumption;

  • Participation in hospitality, nightlife, entertainment, and event activities;

  • Use of physical spaces and facilities;

  • The conduct of other guests, attendees, or third parties.

You agree that the Company is not responsible for any injury, loss, or damage you may suffer in connection with such risks.

15. Indemnification

You agree to indemnify, defend, and hold harmless Something Big Hospitality and its parents, subsidiaries, affiliates, officers, directors, employees, agents, and partners from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

  • Your use of or access to the Site or Services;

  • Your violation of these Terms;

  • Your violation of any applicable law or the rights of any third party;

  • Your conduct at any affiliated venue or event.

16. No Agency or Partnership

Nothing in these Terms, nor your use of the Site, creates any partnership, joint venture, employment, or agency relationship between you and Something Big Hospitality.

17. Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

You agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Services (collectively, “Disputes”) shall be resolved exclusively by binding arbitration, rather than in court, except that you may assert qualifying claims in small claims court.

You waive any right to a trial by jury.

The arbitration shall be administered by a recognized arbitration provider under its applicable rules. The arbitrator shall have the authority to award any relief permitted by law.

18. Class-Action Waiver

You agree that any Dispute shall be conducted only on an individual basis and not in a class, consolidated, or representative action.

You further agree that you may bring claims against the Company only in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

19. Governing Law & Venue

These Terms and any Dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-law principles.

Subject to the arbitration provisions above, any legal suit, action, or proceeding arising out of or related to these Terms or the Site shall be instituted exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

20. Changes to These Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective when posted on the Site.

Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.
